Terms and Conditions

These terms are a contract between you and [legal entity name to be confirmed] (ABN [to be confirmed]) trading as FIRE5 (“FIRE5”, “we”, “us”). Part A applies to everyone who uses our website. Part B applies if you join the FIRE5 Business Network. By using our website or joining, you accept these terms.

Part A: Using our website

1. Our content

Everything on fire5.com.au and our landing pages, including the FIRE5 name and logo, text, photography, video and match footage, belongs to us or our licensors. You may view and share it. You may not copy, reproduce or use it commercially without our written permission.

2. Acceptable use

Do not interfere with the site, attempt to gain unauthorised access, scrape it at scale, or submit false information through our forms.

3. Accuracy

We keep event dates, venues, prize pools and membership details current, but they can change. Details on this site are provided in good faith and are not a guarantee. We will tell you if something you have bought or booked changes materially.

4. Tickets are sold by Flicket

We do not sell event tickets. Ticket sales for FIRE5 events are made by Flicket, and when you click through to buy you leave our site and contract with Flicket. Flicket’s terms and refund policy govern that purchase, including event cancellation, postponement and refunds. Read them before you buy. Nothing in these terms limits any rights you have against Flicket.

We link to third party sites. We do not control them and are not responsible for their content or their terms.

Part B: FIRE5 Business Network membership

6. What membership costs

Membership is A$90 per month plus GST, which is A$99 per month including GST, charged monthly in advance.

New members start with a free trial of 30 days. You must add a valid payment card when you join. Nothing is charged during the trial. At the end of the 30 days, your first payment of A$99 including GST is automatically charged to that card, and the same amount is charged on the same day of each month after that, until you cancel.

We will email you a reminder before the trial ends and before it converts to a paid membership.

We may change the membership price. If we do, we will give you at least 30 days notice by email before the change takes effect, and you can cancel before then at no cost.

7. Cancelling

You can cancel at any time, and cancelling takes no more effort than joining did. Cancel from your member account, or email us at [membership email to be confirmed] and we will action it.

We may suspend or cancel your membership if a payment fails and is not fixed within 14 days of us telling you, or if you breach clause 10.

8. What membership includes

Meeting schedules, formats and the member benefits above may change as the network grows. We will give you notice of any material change and you can cancel under clause 7 if it does not suit you.

We do not guarantee referrals, leads, sales or business outcomes. The network gives you access and exposure. What you get from it depends on you.

Where we offer a free 15-second Level Play advert to the first 100 members in a country, that offer is subject to these conditions:

10. How members behave

Members must deal with each other honestly and professionally. Do not misrepresent your business, harass or spam other members, use member contact details for bulk marketing, or share the member directory outside the network. We may remove a member who breaches this, and no refund is payable for the current month if we do.

Anything another member says in a meeting or on the network is their own view. We do not endorse it and we are not responsible for the dealings you have with other members.

11. Membership fees fund FIRE5

Membership fees help fund FIRE5 competitions and FIRE5 Next Gen youth netball. This is how our business works, not a charitable donation, and membership fees are not tax-deductible as a donation.

Part C: Terms that apply to everything

12. Your rights under the Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to cancel and get a refund for the unused part, or to compensation for any other reasonably foreseeable loss. You are also entitled to have the service put right if it is not of acceptable quality and the failure is not major.

Nothing in these terms excludes, restricts or modifies those rights.

13. Our liability

Subject to clause 12, and to the extent the law allows:

We are not liable for delay or failure caused by something outside our reasonable control, including venue closure, illness, extreme weather or the failure of a third party platform.

14. Privacy

We handle your personal information in accordance with our Privacy Policy.

15. Changing these terms

We may update these terms. For members, we will give at least 30 days notice by email of any change that materially affects you, and you can cancel under clause 7 before it takes effect. For website use, the version on this page at the time you use the site applies.

16. Governing law

These terms are governed by the laws of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of its courts. If you are a consumer in another country, this does not remove any rights you have under the mandatory consumer law of the country you live in.

17. General

If any clause is unenforceable it is severed and the rest stands. Our not enforcing a term is not a waiver of it. You may not transfer your membership to someone else without our written consent.
